Chapter 17.08 BOARD OF APPEALS
Section 17.08.010 Creation, appointment and organization of the board.
A. A board of appeals shall be established.
The word "board," when used in this chapter
shall be construed to mean the board of appeals. The board shall consist of seven members, all of
whom shall be appointed and approved by the governing body. members of the board shall reside
only in the jurisdiction of the municipality subject to the application of the provisions of this
title, and the failure of any member of the board to maintain this residence qualification at any
time shall subject him to removal from the board for cause. The term of office of the members of
the board shall be for five years, excepting that the membership of the first board appointed shall
serve respectively for terms of one for one year; one for two years; one for three years; one for
four years; one for five years; one for six years; and one for seven years. Thereafter, members
shall be appointed for terms of five years each. Vacancies shall be filled for unexpired terms
only. Members shall be removed for cause by the governing body upon written charges and after
public hearing. The governing body shall name one of the members so appointed as chairman at
the time of his appointment and he shall hold the office as chairman until his successor is
appointed. In the absence of the chairman, the board shall elect one of its members as acting
chairman.
B. The board shall adopt from time
to time, such rules and regulations as it may deem
necessary to carry into effect the provisions of this title.
C. Meetings of the board shall be
held at the call of the chairman or any two members or at
such other times as the board may determine. Four members of the board shall constitute a
quorum and a majority vote of the members present shall determine all questions presented to the
board, except as otherwise provided in this title. The chairman shall be entitled to vote upon all
questions presented to the board. Such chairman, or in his absence, the acting chairman, may
administer oaths and compel the attendance of witnesses. All meeting of the board shall be open
to the public. The board shall keep minutes of its proceedings, showing the vote of each member
upon each question, or if absent or failing to vote, indicating such fact, and shall keep records of
its determinations and other official actions, all of which shall be immediately filed with the
secretary of the plan commission and shall be a public record. (Ord. 1258 § 1 (part), 1994: prior
